This writ petition has been filed for issuance of a writ of mandamus, directing the respondent to dispose of the disciplinary action initiated by him in his Memo No. R.C.P7/5578/2023-1 dated 15.11.2023, within a specified time frame that may be fixed by this Honble Court as per the guidelines issued by the Government in Letter No. (Ms)66/N/2024-1 dated 23.07.2024 without any further delay.

2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

When the matter was taken up for hearing, the learned Additional Government Pleader, appearing on behalf of the respondent, submitted that the enquiry officer had been appointed and that four witnesses had already been examined so far. Additionally, he stated that one more witness is yet to be examined. Therefore, he requested three months time to complete the enquiry proceedings initiated against the petitioner.

In view of the above submission, in the interest of justice and to ensure that the issue is adjudicated fairly and without undue delay, this Court is inclined to permit the enquiry proceedings to be conducted and concluded in a time-bound manner. Accordingly, this Court directs the respondent to proceed with the disciplinary enquiry and complete the same within a period of three months from the date of receipt of a copy of this order. It is made clear that the enquiry shall be conducted strictly in accordance with law and the petitioner shall be afforded due opportunity to submit his explanation and to participate in the enquiry proceedings.
