ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Sections 419, 420, 423, 465, 468, 471 r/w 120(b) IPC altered into 419, 420, 423, 465, 468, 471, 120(b) r/w 109 IPC in Crime No.34 of 2018, seeks anticipatory bail.
2.The case of the prosecution is that the defacto complainant's properties were forged by the accused persons. Hence, a case has been registered.
3.There are nine accused persons shown in the First Information Report. The petitioner herein is shown as A9. He was added as accused in this case based on the confession statement given by A1. A1 had stated in his confession that this petitioner had helped in preparing forged document. The petitioner is aged about 85 years old and he has been added as accused only on the basis of confession given by A1.
4.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Land Grabbing Special Court, Tirunelveli and on his executing a https://hcservices.ecourts.gov.in/hcservices/
bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police weekly twice i.e on Monday and Friday at 10.30 am, for a period of two weeks and thereafter, as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
