Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 1st respondent to expedite the appeal filed by the petitioner, dated 03.03.2025, in respect of the property in Survey No.281/1A1 to an extent of 2.16.00 Hectare of Parivirisuriyan Village, Radhapuram Taluk, and dispose the same within a time stipulated by this Hon'ble Court.

ORDER

The petitioner herein seeks a direction to the first respondent to expedite the appeal filed by the petitioner, dated 03.03.2025, and dispose the same within a time stipulated by this Court.

2. It is the case of the petitioner that he and his wife purchased 5 acres and 50 cents of land in Ayan Punja Survey No.281/1A1 (new SubDivision No.281/1A10) of Parivirisuriyan Village, Radhapuram Taluk, Tirunelveli District, in the year 1997. Subsequently, the petitioner and his wife sold 5 acres 9 cents in favour of one Jeyaraj and Elilarunarani. Thus, the petitioner retained 41 cents of the property in the subject survey number. Thereafter, a settlement deed was executed in favour of petitioner's daughter and mutation had also been taken place in the revenue records. In the meantime, the second respondent passed patta transfer order, issuing patta for the entire land in the subject survey number in favour of private respondents 3 and 4. Aggrieved by the same, the petitioner preferred an

appeal before the first respondent on 03.03.2025 and the same has not been considered. Hence, the petitioner has come before this Court.

3. The Additional Government Pleader, who takes notice for respondents 1 and 2, submits that the appeal submitted by the petitioner will be disposed of in accordance with law.

4. In view of the above, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the appeal filed by the petitioner, dated 03.03.2025, and pass final orders on its own merits within a period of sixteen weeks from the date of receipt of copy of this order, after issuing notice to petitioner, private respondents 3 and 4, and other interested parties.

5. Accordingly, the Writ Petition is disposed of. No costs. 24.06.2025 NCC :
