ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the second respondent to take necessary steps to comply the direction issued by the first Respondent, dated 03.04.2025 and dated 12.06.2023.
2. The petitioner has preferred a complaint against one Esakiappan, who is an employee in the office of the Sub Registrar, Kottaram. The said complaint was acted upon and the higher authorities have initiated proceedings against Esakiappan. Now, the petitioner is seeking further action based on the proceedings issued by the first respondent.
3. It is seen that the petitioner is a third party to the disciplinary proceedings. It is a settled proposition of law that a third party cannot seek remedy under Article 226 of the Constitution of India, to take disciplinary action 2/4
against a government employee. Therefore, the present writ petition is a frivolous litigation.
4. With the above observations, this Writ Petition stands dismissed. There shall be no order as to costs.
