ORDER

Seeking to direct the 2nd respondent to consider the petitioner's representation dated 12.05.2026 to grant permission and to provide police protection for taking water from Cauvery river which is scheduled on 12.06.2026 at 07.00 a.m and Palkuda Balabhisekam ceremony which is scheduled to be held on 14.06.2026 from 07.00 a.m and the event of performing suddha Pooja on 15.06.2026 at Panaiyadi Karuppu Swamy temple located in Pallakkadu Village, Athavathur, Srirangam Taluk, Trichy District, this writ petition is filed.

The learned counsel for the petitioner submitted that the temple is an age old temple and has been in existence for over 50 years and they are conducting temple festival every year during the month of May or June from time to time without any difficulty, interference or conflict among the villages. However, when the petitioner organised temple festival this year, the 2nd respondent police required the petitioner to get a proper permission. The petitioner's representation seeking permission and police protection for the conduct of the temple festival is kept pending by the 2nd respondent police 2/4

without consideration. Hence, this writ petition.

3. Heard the learned counsel on either side and carefully perused the materials available on record.

4. It is made clear that the petitioner need not seek permission before the respondent police for conduct of temple festival. However, only in the case of organising Adal Padal or any other cultural program, permission is warranted. As far as the protection is concerned, the 2nd respondent police shall afford necessary police protection on payment of necessary charges in terms of G.O(Ms)No.139, Home (Pol-VIII) Department, dated 04.03.2019. It is made that it is not necessary to get permission from the police for conducting Palkuda Balabhisekam ceremony and taking holy water from river Cauvery and other poojas proposed to be conducted in the festival.
