Respondents PRAYER: Writ Petition has been filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, to direct the respondents 1 to 4 to take action against the 5th respondent in accordance with law.

O R D E R

[Order of the Court was made by S.NAGAMUTHU, J.] The petitioner has come up with this Public Interest Litigation seeking a direction to the respondents 1 to 4 to take action against the 5th respondent in accordance with law, on the allegation that the 5th respondent is compelling the students studying in the Panchayat Union Middle School, Keelaiyur, to do scavenging work inside the school premises. 2.We have heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the official respondents. We have also perused the records carefully. In view of the nature of the order which we propose to pass, notice to the 5th respondent is dispensed with. https://hcservices.ecourts.gov.in/hcservices/

3.The respondents 3 and 4 have made appearance today, on the instructions of the learned Special Government Pleader. They would submit that the 4th respondent received a complaint in this regard and he has also held an enquiry and some of the teachers said that the students are allowed to scavenging work, whereas the other teachers said it has not happened so. It appears that there is no co-ordination among the teachers and because of the said misunderstanding, this issue has been raised.

4. In our considered view, at any rate, the students shall not be allowed to scavenging inside or outside the school premises. To that extent, all the respondents should ensure that it does not happen. Thus, in our considered view, no further action is required in this matter.

5. Accordingly, this Writ Petition is disposed of with a direction to the respondents to ensure that the students shall not be allowed to do any scavenging or cleaning work inside the school premises. No costs.
