ORDER

The petitioner herein seeks direction to the respondents 2 and 3 to remove the entry in the revenue records in favour of the 4th respondent pertains to the property situated in S.No.1789/20 at Kalvarpatti, Iyyalur Village, Vedasundar Taluk, Dindigul District by considering his representation dated 19.02.2025.

2. Heard the learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader who takes notice for the respondents 1 to 3.

3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself. 2/6

4. According to the petitioner, the subject property originally belonged to his mother namely Mahalakshmi under a Settlement Deed dated 08.09.2016. The petitioner's mother died in the year 2020. Thereafter, the patta for the subject property erroneously transferred in favour of the 4th respondent. Therefore, in his capacity of legal heir of Mahalakshmi, the petitioner submitted a representation on 19.02.2025, seeking restoration of patta in the name of Mahalakshmi. The said representation has not been considered. Hence, the petitioner has come before this Court.

5. The learned Government Advocate who takes notice for the respondents 1 to 3 would submit that on the basis of the representation submitted by the petitioner, the 3rd respondent also initiated enquiry and issued notice to the 4th respondent and legal heirs of the said Mahalakshmi.

In view of the submissions made by the learned Additional Government Pleader appearing for the respondents 1 to 3, this Court is inclined to direct the 2nd respondent to consider the representation of the petitioner dated 19.02.2020 and pass final orders on its own merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, 4th respondent and other legal heirs of Mahalakshmi, if any.
