ORDER : The Court made the following order :- 1/4
The petitioner/A1, who apprehends arrest at the hands of the respondent for the offences punishable under Sections 143(2),351(3),115(2) of BNS and Section 92 in the Rights of Persons with Disabilities Act, 2016 in Crime No.54 of 2026 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is the petitioner and other accused persons had committed unnatural sexual assault on the victim who is a mentally challenged person. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and due to election motive a false case has been foisted against him. The petitioner has nothing to do with the alleged crime. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate(Crl.Side) would submit that the petitioner and other accused persons had committed assault on the victim who is a mentally challenged person. He would further submit that investigation is pending. Hence, he opposes to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.
6. Considering the rival submissions on either side and considering the nature of offences and also the fact that investigation is pending and since the alleged offence is grave in nature, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
7. Hence the petition stands dismissed.
