Prayer: Writ Petition filed under Article 226 of the Constitution of India praying this Court to issue a Writ of Certiorarified Mandamus, calling for records of the impugned order passed by the third respondent herein in his proceedings in Oo.Mu.No.1513/A2/2025 dated 28.05.2025 and quash the same as illegal and further directing the third respondent to accord prior permission to fill up the post of B.T.Assistant (Science) and release the grant in aid to the Hindu Nadar Uravinmurai Committee Higher Secondary School, T.N.Pudhukudi, Puliyankudi, Tenkasi District within a time stipulated by this Court.

The challenge in this writ petition is to the order rejecting the petitioner's claim for approval of appointment as B.T.Assistant (Science), on the ground that they are awaiting orders from the Secretary to Government and that the request of the petitioner will be considered only after such orders are passed.

2. It is also placed on record that there are no surplus teachers in the petitioner School.
3. This Court is of the view that the surplus teachers in the other schools other than the petitioner's school cannot be taken as a ground to reject the claim of the petitioner.
4. In such view of the matter, the impugned order is set aside and the issue is remitted back to the third respondent to re-consider the case of the petitioner and pass appropriate orders on merits and in accordance with law within a period of 6 weeks from the date of receipt of a copy of this order.
5. In fine, this writ petition stands allowed. There shall be no order as to costs.
