For Petitioners : No appearance For Respondents : No appearance COMMON ORDER This Petition is filed to recall the order passed by this Court dated 28.11.2024 passed in W.P.(MD) No.17746 of 2024 , thereby setting aside the refusal check slip dated 19.07.2024, passed by the fourth respondent herein and directed to represent the sale lead for registration and on receipt of the same, the second respondent is directed to register the sale deed and release the same forthwith.

2. The petitioner claims to be the original owner of the subject property and pointed out that even in the refusal check slip which was impugned in the writ petition categorically mentioned that the subject property which was allegedly settled by the 1st respondent herein in favour of the second respondent herein, registered by document No. 3686 of 2016 was cancelled vide Document No. 5142/2017, on the complaint lodged by the petitioner. That apart, the current document was also cancelled by the cancellation deed registered vide document No. 3686/2016. Therefore, the first respondent has no title over the subject property to deal with the same. However, it was suppressed before this Court and an order was obtained by the respondents 1 and 2 herein. 2/4

3. Though was notice served on the respondents 1 and 2 and name printed in the cause list, no one is appeared before this Court, either by person or through counsel.

4. Therefore, this Court is inclined to recall the order passed by this court vide order dated 28.11.2024 passed in W.P.(MD) No.17746 of 2024 and accordingly, recalled and the writ petition itself is dismissed.

5. In the result, this Writ Miscellaneous Petition is allowed. 13.02.2026 LS TO
