To relax the condition imposed upon the petitioner in Crl.M.P(MD)No.9864 of 2026 in Crl.A.(MD).No.377 of 2023 dated 07.05.2026.

ORDER

The petitioner was granted suspension of sentence by this Court vide order dated 24.03.2026 in Crl.M.P.(MD) No.17307 of 2023, subject to the condition that the petitioner shall reside at Trichy and report before the Inspector of Police, Uppliyapuram Police Station, daily at 10.30 a.m., until further orders. The said condition was subsequently relaxed by order of this Court dated 07.05.2026 in Crl.M.P.(MD) No.9864 of 2026, imposing a condition that the petitioner https://www.mhc.tn.gov.in/judis

shall reside at Madurai and report before the Inspector of Police, Anna Nagar Police Station, daily at 10.30 a.m., until further orders.

2. The learned Government Advocate (Criminal Side) submits that the petitioner has complied with the condition imposed at Trichy regularly; however, the petitioner has failed to comply with the condition imposed at Madurai from 03.06.2026 onwards.

3. The petitioner has been found guilty of an offence under the POCSO Act. Therefore, this Court has directed that the petitioner be kept at a distant place and has further imposed a condition that the petitioner shall file an affidavit of undertaking before the respondent Police that he will not visit the scene village during the pendency of the appeal. It appears that the petitioner has failed to comply with the condition imposed at Madurai. In view of the conduct of the petitioner and having regard to the nature of the offence committed, this Criminal Miscellaneous Petition is dismissed.
