: Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents herein to give the permission, police protection and sound service for conducting Temple Festival on 28.04.2017 at about 5.00 P.M. And on 29.04.2017 Annadhanam at about 10.00 A.M. For two days Arulmigu Sri Oorkavalsamy Temple situated at North Kalankarai, Korampallam Post, Thoothukudi District based upon the petitioner representation dated 26.04.2017.

The learned counsel for the petitioner is present. The Additional Government Pleader takes notice for the respondents herein. Mr.S.Sundararaj, Special Sub Inspector, Pudukottai Police Station assisted Additional Government Pleader. 2.The learned counsel for the petitioner states that every year, during the Tamil month of Chithirai, Annual Festival will be conducted for the Arulmigu Sri Oorkavalsamy Temple and temple festival to be conducted on the night of Thiruvizha Celebration Day as a customary celebration.

3.The learned counsel for the petitioner further states that for the conduction of the temple festival on 28.04.2017, a representation dated 24.04.2017 was given by the petitioner herein to the second respondent in person, for seeking permission and police protection for the temple festival scheduled to be held at North Kalankarai Village on 28.04.2017. Having received the representation, the second respondent stated that after getting the concurrence opinion from the higher officials, permission will be granted. The learned Counsel for the petitioner further submits that one more representation was given to the first respondent dated 26.04.2017. But till date, the said representation has not been considered.
4.Hence the petitioner filed this Writ Petition seeking direction to the respondents to give permission and police protection for conducting the temple festival on 28.04.2017, and 29.04.2017, for two days at Arulmigu Sri Oorkavalsamy Temple situated at North Kalankarai Village, Thoothukudi District, based on the representation, dated 26.04.2017.
5.The Additional Government Pleader states that a Peace Committee was conducted on 27.04.2017, and it was agreed to conduct the celebrations as per the proceedings dated 27.04.2017, and the respondents police are prepared to give police protection in terms of the proceedings of the Taluk Thasildar Thoothukudi District dated 27.04.2017.
