PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the learned Sessions Judge, Special Court for Exclusive Trial of Cases under SC/ST Act (POA), Pudukkottai, to consider the bail application of the petitioner in Cr.No.89 of 2026 on the file of the 2nd respondent police on the same date of surrender and dispose of the same on its merits in accordance with law.

ORDER

The present petition has been filed by the 6th accused in crime No.89 of 2026, on the file of the second respondent police seeking a direction as against the trial Court to consider the bail application of the petitioner on the same day of surrender.

2. Considering the averments in the petition, there shall be a direction to the learned Sessions Judge, Special Court for Exclusive Trial of Cases under SC/ST Act (POA), Pudukkottai, to consider the bail application of the petitioner on the same day of surrender in crime No.89 of 2026, after giving due opportunity to the defacto complainant.

3. The petitioner shall surrender before the concerned Court on or before 15.06.2026.

4. With the above said observations, this Criminal Original Petition stands allowed.
