PRAYER: Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Certiorarified Mandamus calling for the records relating to the impugned suspension order in G.O.(2D)No.96, dated 30.04.2019 passed by the first respondent, quash the same and consequently, directing the first respondent to make the retirement of the petitioner immediately from his employment as Deputy Collector, on the afternoon of 30.04.2019, with all pensionary benefits and arrears of pension. ORDER

This writ petition is filed by the petitioner challenging the order of suspension dated 30.04.2019.

2.When the writ petition is taken up for hearing, learned Counsel on either side submitted that the charge memo has been withdrawn and consequently, the suspension order has been recalled on 02.03.2023 and the petitioner was also permitted to retire from service. 2/5

3.Learned Counsel for the petitioner has not disputed the same, however, submitted that the terminal benefits has not been settled to the petitioner in view of the pendency of this writ petition. 4.Since it is reported that the charge memo, based on which the impugned suspension order was issued as against the petitioner, was already withdrawn and the petitioner was also allowed to retire on the date of superannuation, the respondents shall process the terminal benefits of the petitioner and disburse the same, as expeditiously as possible. Accordingly, this writ petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
