PRAYER :- To grant bail for the petitioner/accused in S.C.No. 157 of 2024 on the file of the Learned IV th Additional District and Sessions Judge, Tirunelveli District. ORDER : The Court made the following order :- The petitioner, who arrayed as accused was arrested and remanded to judicial 1/3

custody on 28.08.2023 for the offences punishable under sections 147, 148,341, 294(b), 302 and 506(ii) IPC @ into Sections 147, 148, 341, 294(b), 302, 506(ii), 120(B) and 34 IPC in Crime No.332 of 2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that due to previous motive, the petitioner herein and other accused unlawfully assembled with deadly weapons and wrongfully restrained the decased Ganesn and attacked the deceased with Aruval and caused death. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that due to the previous motive, the name of the petitioner has been falsely implicated in this case and further some of the accused were released on bail. He would further submit that the petitioner is in jail from 07.09.2023 and prays for granting bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner herein is a habitual offender and the investigation in this case has already been completed and the charges also framed.

5. Considering the submission made by the leanerd Additional Public 2/3

Prosecutor and also considering the gravity of offence, this Court is not inclined to grant bail to the petitioner.
