PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India, to direct the District Munsif, Uthamapalayam to dispose of O.S.No.6 of 2021, within time framed as may be fixed by this Court.

This Civil Revision Petition is filed to direct the learned District Munsif, Uthamapalayam to dispose of O.S.No.6 of 2021, within the stipulated time fixed by this Court. 1/4

2.The learned counsel appearing for the petitioner submits that the suit in O.S.No.6 of 2021 has been filed by the respondents herein, for permanent injunction. According to the learned counsel for the petitioner, the lease agreement for the suit property, dated 06.09.2018 itself has been expired on 06.09.2021 and hence the suit is not maintainable. Hence, a suitable direction may be issued to the learned District Munsif, Uthamapalayam to dispose of the suit at the earliest.

3. This Court considered the submissions of the learned counsel for the petitioner and also perused the materials placed on record.

4.Perusal of the records shows that the suit in in O.S.No.6 of 2021 was filed by the respondents herein for the relief of permanent injunction, wherein, issues have been framed on 28.02.2022 and thereafter it was adjourned periodically and finally posted to 2/4

05.07.2022 for trial.

5.Considering the limited prayer sought for by the petitioner and taking into consideration the fact that trial has been commenced, this Court is inclined to dispose of this Civil Revision Petition with a direction to the learned District Munsif, Uthamapalayam, to dispose of the suit in O.S.No.6 of 2021, within a period of one year from the date of receipt of a copy of this order.

6. With the above direction, this Civil Revision Petition is disposed of. No costs.
