ORDER

This Civil Revision Petition is filed challenging the order passed by the III Additional District Court, Trichirapalli in RLTA No.16 of 2023 dated 08.04.2025 upholding the fair and decretal order passed by the Principal District Munsif Court, Musiri in RLTOP No.1 of 2021 dated 25.04.2023. 1/4

2.Since no adverse order is going to be passed in this Civil Revision Petition as against the respondent, notice to the respondent is dispensed with. 3.The petitioner is the tenant under the respondent. The respondent/landlord filed a petition before the Rent Control Tribunal in R.L.T.O.P.No.1 of 2021 for evicting the petitioner on the ground of own use and the said petition was allowed. Challenging the same, the petitioner filed an appeal in R.L.T.A.No.16 of 2023. The said appeal was dismissed on 08.04.2025. Aggrieved by the said order, the petitioner has filed the present Civil Revision Petition.

4.The learned counsel for the petitioner submits that the petitioner has already filed a suit for preemption in O.S.No.202 of 2023 and the said suit is pending before the Sub Court, Musiri.

5.The learned counsel for the petitioner further fairly submits that this Civil Revision Petition shall be disposed with liberty to the petitioner to approach the civil Court and obtain any restraint order as against the order of eviction.

6.In view of the limited request made by the learned counsel for the petitioner, this Civil Revision Petition is dismissed with liberty to the petitioner to work out his remedy in the manner known to law. The respondent is also at liberty to file an application before the Rent Control Appellate Authority for eviction in accordance with law. No costs. Consequently, connected miscellaneous petition is closed.
