2. Learned counsel appearing for the first respondent has not raised any serious objection for allowing this civil miscellaneous petition.

3. Though the second respondent has been served and his name has been printed in the cause list, he has not appeared either in person or through his counsel.

4. Since there is no objection on the part of the first respondent for allowing this civil miscellaneous petition, this civil miscellaneous petition is allowed and the delay of 74 days in filing the above writ appeal is condoned.
