For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.226 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 406 and 420 of IPC, in Crime No.226 of 2022, seeks anticipatory bail.

2.The case of the prosecution is that the first accused and the petitioner are close relatives and the petitioner by showing the first accused's photo stated that he is working in District Collector Office (DROJ) and received more than Rs.9,00,000/- for obtaining Government Job from the general public including the defacto complainant also. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent persons and he has not committed any offence as alleged by the prosecution.

4. The learned Additional Public Prosecutor appearing for the respondent police submitted that on 01.07.2022, the first accused appeared before the Deputy Superintendent Of Police and gave a statement against the petitioner.

5.The learned counsel for the petitioner submitted that the confession statement cannot be taken as evidence against the petitioner at all. He would further submit that he appeared before the District Crime Branch and gave a cheque to the tune of Rs.6,50,000/- on behalf of the petitioner by accepting liability.

6. Taking into consideration the allegations and also gravity of the offence committed by this petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
