Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondent Nos.1 to 3 to provide interest at the rate of 12% for the belated payment of all terminal benefits to the tune of Rs.19,84,586/- (Nineteen Lakhs Eighty Four Thousand Five hundred and Eighty Six only) to the petitioner for the period from 01.01.2013 to 29.07.2016 by considering the petitioner's representation dated 29.08.2016 within a stipulated time. O R D E R

The petitioner has come up with this Writ Petition seeking a direction to the respondents to consider the representation of the https://hcservices.ecourts.gov.in/hcservices/

petitioner, dated 29.08.2016, wherein he has claimed interest for the belated payment of retirement benefits, as provided under Rule 45(A) of the Tamil Nadu Pension Rules, 1978.

2.We have heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents.

3. A perusal of the above said Rule would go to show that the petitioner is entitled for interest for the belated payment of retirement benefits, about which there can be no denial. In view of the same, the respondents are directed to consider the representation of the petitioner dated 29.08.2016 and pay interest for the belated payment of retirement benefits as provided under Rule 45-A of the Tamil Nadu Pension Rules, 1978, within a period of four weeks from the date of receipt of a copy of this order. No costs.
