For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor (Crl.side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.253 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner is facing charges under Sections 294(b), 353, 465, 467, 468, 470, 472 and 420 IPC in Crime No.253 of 2022 on the file of the respondent police.
2.The case of the prosecution is that the defacto complainant lodged a complaint stating that on 14.07.2022 at about 02.00 pm., he came to know that the accused person, namely, Ganesan, Vasantha Kumar, Suresh and Raja informed that they are going to arrange the loan by fabricating the rubber stamp. So, he was apprehended. 3.All the 4 accused persons have been produced before the police station by the defacto complainant and other. Based upon the same, the aforesaid case has been registered. During the course of investigation, it was found that this petitioner alleged to have made the aforesaid rubber stamp and supplied the same to the cohttps://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.13860 of 2022 accused. Based upon the aforesaid involvement only, he has been implicated in this case.
4.The learned counsel for the petitioner would submit that the petitioner is noway informed about the misuse of the rubber stamp by the co-accused and he is a professional seal maker and he does not have any knowledge about the same.
5.However, considering the fact that serious allegation of making the fake rubber stamp and seal has been made, the petitioner must be subjected to custodial interrogation to bring out the truth. The offence of such nature cannot be taken lightly. So, the petitioner is not entitled for the discretionary relief of anticipatory bail.
6.This Criminal Original Petition deserves to be dismissed and accordingly, dismissed.
