Prayer in W.P.(MD)No.16690 of 2025 : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents 2 and 3 to conduct Survey, Measurement and to fix the four boundaries of the petitioner property comprised Survey No.75/14A situated in Panakattankudi Village, Thiruvidaimaruthur Taluk, Thanjavur District to an extent of 0.3.50 Ares with the aid and protection of the 4th respondent, forthwith the Petitioner's representation dated 09.04.2025.

ORDER

By this common order both the writ petitions are being disposed of.

2. The petitioner herein seeks direction to the respondents to conduct survey in his property situated in Survey No.75/14A at Panakattankudi Village, Thiruvidaimaruthur Taluk, Thanjavur District, by considering his online application dated 09.04.2025.

3. Heard the learned counsel appearing for the petitioner, Mrs.K.Malathi, learned Additional Government Pleader who takes notice for the respondents 1 to 3 and Mr.M.Vaikkam Karunanithi, learned Government Advocate who takes notice for R4.

4. By consent of both the parties, these writ petitions are taken up for final disposal at the stage of admission itself.

5. According to the petitioner the subject properties were purchased by his mother under a registered Sale Deed dated 20.06.1996. The patta for the subject property stands in the name of the petitioner's mother and 3/6

father in Patta Nos.733 and 438. The petitioner submitted two separate online applications on 09.04.2025 in A.No.2025/0123/21/008156 and A.No.2025/N123/21/007525 respectively. The same has not been considered and hence, the petitioner has come before this Court.

6. The learned counsel for the petitioner submits that in W.P.(MD)No.16691 of 2025, the petitioner seeks survey of the property situated in S.No.75/14B and the same has been wrongly mentioned in the writ prayer as S.No.75/14A. The said statement made by the petitioner stands recorded.

7. Mrs.K.Malathi, learned Additional Government Pleader, who takes notice for the respondents 1 to 3 would submit that the online application submitted by the petitioner dated 09.04.2025 will be considered in accordance with law.

8. In view of the same, without expressing any opinion on the merits of the matter, the respondents 2 and 3 are directed to consider the online application of the petitioner dated 09.04.2025 and pass final orders on its 4/6

own merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, neighbouring land owners and other interested parties.

9. These writ petitions are disposed of with the above observations. No costs.
