PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records of the Impugned order passed by the 2nd respondent in the proceedings in Ref.No. 4727/SCSIII/2025 dated 11.03.2025 quash the same consequently directing the 2nd respondent to give admission to the petitioner in any other college under the Government Quota for the Paramedical Course.

ORDER
Heard the learned counsel for the petitioner, learned Government Advocate for the first respondent, learned counsel for the second respondent and the learned Senior Counsel for the third respondent.
2.In this writ petition, the petitioner has challenged the impugned communication, dated 11.03.2025 of the second respondent. 2/7
3.Earlier, an order came to be passed on 19.06.2025, wherein, the facts of the case are recorded. They read as under:- "2.The petitioner is aggrieved by the impugned order of the Selection Committee. The impugned order has been signed by the Additional Director of Medical Education & Research Secretary wherein the petitioner has been informed as follows: New Government Quota seat in self financing Nursing College cannot be allotted to the student Vaishnavi as last date of cut off for admission for B.Sc., Nursing course as per the Indian Nursing Council Regulations and Tamil Nadu Dr.M.G.R. Medical University got over on 30.11.2024. New admission cannot be done beyond the cut off date as per their regulations. So the candidate is hereby permitted to continue the B.Sc., Nursing Course in Srinivasan College of Nursing, Samayapuram, Trichy if she is willing.
If you are not willing to continue the B.Sc., Nursing course at Srinivasan College of Nursing, Samayapuram, Trichy, we have instructed the institution to return all the original certificate and Fees paid.
3.The learned counsel for the petitioner submits that the petitioner is unwilling to continue her studies at the third respondent College, as she has been threatened by them. The learned counsel further submits that, in view of the petitioner's unwillingness to continue her education at the said College due to her past experience there, she may be accommodated in another nursing college for the academic year 2024-2025, which commenced on 19.11.2024. 4.The learned Government Advocate appearing for the first and second respondents submits that the question of accommodating the petitioner in any other college for the academic year 2024-2025 cannot be considered at this stage, as the academic year is nearing its 3/7
end and almost nine months have already passed. However, he submits that the petitioner can be accommodated in the ensuing admission against the Government quota.
5.Since the petitioner is not willing to continue her studies at the third respondent College, there shall be a direction to the first and second respondents to ensure that the original certificates of the petitioner are returned and the fees paid by her are refunded by the next date of hearing.
6.Issue notice to the third respondent returnable by four weeks. Private notice is also permitted"
4.The learned Senior Counsel for the third respondent submits that if the petitioner appears before the third respondent college, the certificates of the petitioner will be returned and the fees paid by her will also be refunded back. However, it is informed that unless the petitioner is present in person, the fees and the certificates cannot be returned.
5.The learned counsel for the petitioner would submit that the petitioner will be present before the third respondent college on 31.07.2025 at 10.30 am., in the Dean's Office along with her parents.
6.Recording the submissions of the learned counsel for the petitioner and the learned Senior Counsel for the third respondent, the respondents are directed 4/7
to return the fees and the certificates given by the petitioner at the time of her admission to the third respondent college.
7.As far as the request of the petitioner for accommodating her in Paramedical Course in any other college for the academic year 2024-25 is concerned, the same is not feasible, as the current academic year ie., 2024-25 is coming to an end.
8.Considering the same, the second respondent/the Secretary, Selection Committee, Chennai, is directed to consider the petitioner's candidature under the relevant Quota for the ensuing academic year ie., 2025-26 as and when the admissions are opened and the applications are called for. 9.With the aforesaid directions, the Writ Petition stands disposed of.
