O R D E R

This Writ Petition has been filed by the petitioner, seeking to direct the 1st respondent to grant permission to conduct the Cricket Match in Taluk Level which has been scheduled from 14.05.2017 to 21.05.2017 at Krishanan Kovil Play ground, Arunachalapuram Village, Kadaiyanallur Taluk, Tirunelveli District by considering the petitioner's representation dated 18.04.2017.

Learned counsel for the petitioner would submit that the petitioner is organising only a sports event and has given a representation dated 18.04.2017 to the respondents seeking permission for the same. Since no decision has been taken by the respondents so far, he is before this Court. The learned counsel undertakes that the petitioner would not give any political colour to the Cricket Game, scheduled to be held from 14.05.2017 to

21.05.2017 and petitioner is prepared to abide by the conditions by the respondents, if the respondents grant permission for conducting Kabadi Game. The undertaking given by the learned counsel for the petitioner is recorded.

Learned Government Advocate appearing for the respondents heavily opposing the prayer, submitted that in the event of this Court granting permission to the petitioner to conduct the game, stringent conditions should be imposed for maintaining law and order and also to avoid any untoward incident during performance of such tournament.

4. Heard the learned counsel for the parties and perused the materials available on record.

Taking note of the fact that the petitioner is going to organise only Cricket Game, keeping it open to everyone in the village and outside the village, beyond religion, caste, community and party, this Court is of the view that no prejudice would be caused to the respondents, if the relief sought for by the petitioner is granted. Hence, the respondents are directed to grant permission to conduct the Cricket Match in Taluk Level, scheduled from 14.05.2017 to 21.05.2017 at Krishanan Kovil Play ground, Arunachalapuram Village, Kadaiyanallur Taluk, Tirunelveli District, subject to the following conditions:- i) The petitioner should ensure that Cricket Game should not spill over beyond 10.00 P.M;

ii) the petitioner and other participants should not raise any slogan about the party or party leader;

iii) the petitioner should ensure that there will not be any untoward incident, causing disturbance to the public peace and tranquility; and iv) the petitioner should also ensure proper first-aid arrangements, by keeping one or two doctors.

If any of the above said conditions are violated, it is open to the respondents to take appropriate action, in accordance with law.

6. With the above direction, this petition is disposed of. No costs.
