Side) for the respondent. 3.The learned Government Advocate (Criminal side) for the respondent submitted that the petitioner is shown as an accused in a case arising under Section 138 of the Negotiable Instruments Act, on the file of the 7th Additional Civil Judge and Judicial Magistrate Court, Baran, Rajasthan State in C.C.No.274 of 2019. He would further submit that till date, the second respondent has not received any requisition from the complainant or the third respondent. Therefore, there is no cause of action for maintaining this complaint. It is always open to the petitioner to surrender before the concerned Jurisdictional Magistrate and apply for recall or the warrant.
