ORDER

The petitioner with a grievance that his annual increments for certain periods were not provided and therefore his pension was not calculated in accordance with the eligible amount, has submitted a representation to the 1/4

respondent and has also filed this writ petition seeking mandamus directing the respondent to grant him the increments, which were eligible for a Special Grade Driver and also consequently to revise his pension, gratuity and provident fund amounts.

2.When this writ petition is taken up for hearing, the learned Standing Counsel appearing for the respondent submits that this petitioner was unauthorizedly absent for duty on several occasions and therefore those unauthorised absence were treated as loss of pay. If a person is on loss of pay, he is not entitled for increments. Therefore, the petitioner was not provided with increments during the said unauthorized periods. Apart from that the petitioner has also been imposed with punishments for his unauthorized options for 20 times.

3.The learned Counsel by referring the proceedings of the General Manager dated 16.12.2024 submits that the representation of this petitioner dated 17.02.2021 was duly considered as per the regulation and the same was rejected. He also produced a copy of the same. 2/4

4. Since the request of the petitioner has already been rejected this writ petition is closed with liberty to the petitioner to challenge the order dated 16.12.2024 in the manner known to law.
