PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the third respondent to grant 15 days Emergency Leave without escort to the petitioner's husband namely Joklin, S/o.Berkmans, Convict Prisoner (PID 462497) now confined under Central Prison, Palayamkottai in light of his various health ailments based on the petitioner's representation dated 12.05.2025 and for other reliefs. ORDER
(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents would submit that based on the representation given by the petitioner dated 12.05.2025, the respondents have granted three days emergency leave to the petitioner's husband with escort.
2. The learned counsel appearing for the petitioner prays that the petitioner's husband may be permitted to go on leave without escort.
3. Taking into consideration the fact that the petitioner has been granted leave for first time and also taking into consideration the nature of the offence, we are not inclined to interfere with the order of the third respondent. Accordingly, this petition is dismissed.
