ORDER
The petitioner seeks the expeditious disposal of proceedings bearing No. O.Mu.Aa1/5392/2021, dated 16.08.2021 in relation to the rectification of an alleged error in Patta No.217 by omitting S.No.50/5 therefrom.
2.The petitioner states that the land bearing S.No.50/5 of an extent of 0.08.00 ares at Mettu Thottiyankulam, Aruppukottai Taluk, Virudhunagar District was originally allotted to one P.Muthupetchiammal under settlement proceedings. The said Muthupetchiammal executed a sale deed on 28.10.1957 in favour of the 1/3
petitioner's great grandfather. Eventually, it is stated that the petitioner inherited such property from his father. In such circumstances, the petitioner states that Patta No.217 was issued in the name of his grandfather, Ramasamy Mooper. However, it is stated that S.No.50/5 was erroneously omitted to be included therein. After submitting a representation in such regard on 07.07.2021, the present writ petition is filed because the said representation was not disposed of in spite of initiating action in terms thereof on 16.08.2021.
3.Mr.K.S.Selva Ganesan, learned counsel for the State, accepts notice on behalf of all the respondents. He submits that the Revenue Divisional Officer may be directed to consider and dispose of the petitioner's request on merits.
4.The petitioner has enclosed the settlement land register extract in the name of one P.Muthupetchiammal. The sale deed dated 28.10.1957 in favour of his great grandfather, P.Ramasamy is also enclosed. The patta bearing No.217 in the name of Ramasamy Mooper is enclosed. In the circumstances, the petitioner is entitled to a consideration of his representation.
5.Accordingly, without going into the merits of the matter, the second respondent is directed to consider the petitioner's representation for rectification of the alleged error in Patta No.217. Such representation shall be considered and disposed of by a reasoned order within a period of three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner.
6.W.P.(MD)No.16779 of 2021 is disposed of on these terms without any order as to costs.
