ORDER

The petitioner, who is the defacto complainant in STC.No.692 of 2021 on the file of the Fast Track Court / Magistrate Level, Karur District, has filed this petition seeking a direction to the learned Judicial Magistrate to conclude the trial, within a time frame. 1/4

2.The learned counsel appearing for the petitioner submits that the complaint, which was filed in the year 2021, has not been taken up for hearing and there is no progress. Even, his evidence was not recorded so far. The learned counsel claims that the accused is evading the proceedings. A warrant has also been issued, however, it was not executed.

3.In the event, if the warrant is pending, it is open to the petitioner to workout his remedy by filing necessary petition for attachment of properties or to declare the accused as proclaimed offender. The petitioner without invoking the available remedies, has filed this petition. The trial Court shall ensure that the warrant which is pending from the year 2022 is executed within a reasonable time. The learned Magistrate shall apprise the concerned Police Officer and shall ensure that the warrant, which was issued on 15.07.2022, is executed within a period of two months from the date of receipt of a copy of this order. Accordingly, this criminal original petition is disposed of. 16.07.2025 gns 2/4
