O R D E R
The Petitioner herein seeks a direction to the respondents 2 and 3 to conclude the enquiry initiated by the second respondent based on the representation of the Petitioner, dated 4.7.2022 seeking patta in respect of the land in Survey No.225/4 measuring an extent of 35 cents situated at Muduvarpatti Village, Vadipatti Taluk,Madurai District.
2.Mr.D..Nedunchezhian, learned Government Advocate takes notice for the respondents 1 to 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the Petitioner, there are three temples situated in the subject property by name, Shri Kamatchiamman, Shri Kancharadi, Shri Kaluvadi Temple. Families residing at 52 villages mentioned in the representation of the Petitioner has been worshipping the deities in the above mentioned temples, for several years. The Petitioner submitted a representation before the 2/6
respondents 1 and 2 on 4.7.2022 seeking issuance of patta in the name of temples. In response to the representation submitted by the Petitioner, the second respondent initiated an enquiry in his proceedings in O.Mu.No.4892/2022/H, dated 6.7.2022 and directed the third respondent to consider the request of the Petitioner and pass necessary orders in respect of the same. The said representation has not been considered till date, Therefore the Petitioner has come before this Court with the present Writ petition for the relief stated supra.
4.Mr.D.S.Nedunchezian, learned Government Advocate who takes notice for the respondents 1 to 3 would submit that the third respondent/Tahsildar can consider the request for issuance of patta only upto three cents. The Petitioner seeks patta for 43 cents. He would further submit that the Commissioner for Land Administration is the competent authority to consider the request of the Petitioner, seeking issuance of patta for 43 cents. 5.In view of the same, without going into the merits of the matter, the third respondent is directed to consider the representation of the Petitioner, dated 4.7.2022 and submit his report before the competent authority namely, the Commissioner for Land Administration within eight weeks from the date of 3/6
receipt of a copy of this order and on receipt of report from the third respondent, above said authority shall consider the representation of the Petitioner and pass orders on its own merits after issuing notice to the Petitioner and other interested parties, if any, within a period of 12 weeks from the date of report from the third respondent.
6.With the above directions, the Writ Petition stands disposed of. No costs.
