ORDER

This Civil Revision Petition is filed challenging fair and decretal order dated 27.01.2025 passed in E.A.No.1 of 2024 in E.P.No.31 of 2021 in O.S.No. 136 of 2014 on the file of the learned Subordinate Judge, Padmanabhapuram. 1/4

2.Today, when the Civil Revision Petition is taken up for hearing, the learned counsel for the petitioner filed a memo before this Court stating that the dispute between the parties is amicably settled and the petitioner agreed to discharge the debt.

3.Pursuant to the earlier direction of this Court, the petitioner has already deposited a sum of Rs.3,63,000/- to the credit of E.P.No.31 of 2021 on 03.07.2025. Further, he also agrees to pay the remaining sum of Rs.4,00,000/- towards the decree in O.S.No.136 of 2014 as full and final settlement on or before 29.08.2025.

4.The petitioner and the respondent are present before this Court and they admitted that they have entered into such a settlement. 5.In view of the settlement arrived between the parties, this Civil Revision Petition is disposed of on the following terms: (i)The petitioner is directed to pay a sum of Rs.4,00,000/- (Rupees Four Lakhs only) to the credit of E.P.No.31 of 2021 as full and final settlement towards the decree in O.S.No.136 of 2014 on or before 29.08.2025 apart from the amount already deposited by the petitioner to the tune of Rs.3,63,000/-. 2/4

(ii) On such deposit, the respondent shall withdraw the said amount. The trial Court is also directed to disburse the amount already deposited by the petitioner to the respondent.

(iii) It is also made clear that if the petitioner fails to pay the said amount within the time stipulated, the decree made in the original suit will be restored and the respondent is at liberty to proceed with the execution proceedings in accordance with law.

There shall be no order as to costs. Consequently connected Miscellaneous Petition stands closed.
