ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed the present Writ Petition seeking a direction to the respondents 1 to 3 herein to remove the encroachment made by the respondents 4 to 7 in petitioner's house property situated at old door 2/6

No.35A, new door No.135, Thaththaneri Main Road, Bharathi Nagar, Madurai City based on the petitioner's representation dated 06.05.2025. 2.We have heard the submissions made on either side and perused the materials available on record.

3. The status report filed by the third respondent states that the respondents 4 to 7 had encroached the road which is comprised in Town Survey No.2289/1 and fixed the Vinayagar Statue with cement floor and builds the roof with Ashpatas by connecting the Iron rod with the wall of the said Muthumariamman temple. The said encroachment measured towards East to West - 5 feet and South to North - 7 feet and the same are all to an extent of 35 sq. ft. The said encroachment has been informed to the Commissioner, Madurai Corporation.

4. The learned counsel appearing for the second respondent submits that the encroachment has now been identified and will be removed in accordance with law within a period of three months. 3/6

In such view of the matter, the authorities concerned are directed to take necessary action for the removal of such encroachment, after affording sufficient opportunity of personal hearing to all the parties concerned and by following due process of law, within a period of three months from the date of receipt of a copy of this order. 6.With the above directions, this Writ Petition is disposed of. No costs.
