ORDER : This civil miscellaneous petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.K.P.NARAYANAKUMAR, Advocate for the petitioner and of not appeared for Respondent Nos.1 and 2 in person or through by an Advocate and of Mr.A.S.MATHIYALAGAN, Advocate on behalf of the Respondent No.3, the Court made the following order:- This petition is filed to condone the delay of 461 days for filing the Civil Miscellaneous Appeal against the judgment and decree passed by Motor Accident Claims Tribunal, Sub Court, Padmanabhapuram, in M.C.O.P.No.40 of 2016.
2. The learned Counsel appearing for the third respondent raises strong objection to allow this petition.
3. Heard the learned counsel for the petitioner/appellant.
4. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is allowed on the condition to pay costs of Rs.1,000/- (Rupees Thousand only) to the High Court Legal Services Committee attached to this Court, 2/3
