O R D E R

The petitioner challenges the order passed by the respondent dated 05.06.2025, which, according to the petitioner, was communicated to him on 27.04.2026, in exercise of powers under Section 87 of the Tamil Nadu Cooperative Societies Act, 1983.

2.Against an order passed under Section 87 of the Tamil Nadu Cooperative Societies Act, 1983, an effective and efficacious statutory remedy of appeal is available under Section 152(1) of the Act. Since the petitioner has approached this Court without exhausting the said statutory remedy, this Court is not inclined to entertain the writ petition. 3.Accordingly, the writ petition stands disposed of with the following directions:

(i) The petitioner is at liberty to avail the statutory remedy by filing an appeal under Section 152(1) of the Tamil Nadu Cooperative Societies Act, 1983, if so advised and in accordance with law. (ii) If such an appeal is filed within four weeks from today, the 2/4

appellate authority shall consider the appeal on merits without going into the question of delay.

(iii) All rights and contentions of the parties are left open to be urged before the competent authority.

4.There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
