ORDER
The petitioner claims that his father had developed a residential layout in Survey No.118/1B, measuring an extent of 3 acres and 47 cents, situated at Sivagiripatti Panchayat, Thattankulam Village, Palani Taluk, Dindigul District. As per the terms and conditions of the layout approval, an extent of 15,300 sq. ft. was reserved for Park/Open Space. In compliance with the provisions of the Tamil Nadu Town and Country Planning Act, 1971, the said extent was gifted to the local body through a registered Gift Deed dated 31.05.1999.
2. The apprehension of the petitioner is that respondents 2 and 3, instead of maintaining the gifted land as Park/Open Space, are attempting to alter the nature of the land. Therefore, the petitioner submitted a representation to respondents 2 and 3 seeking maintenance of the said 2/6
land as Park/Open Space.
3. The grievance of the petitioner is that the said representation has not been considered till date.
4. Learned Government Advocate appearing for the respondents submitted that the representation would be considered in accordance with law within the time frame stipulated by this Court.
5. The said submission is placed on record.
6. Accordingly, this Writ Petition is disposed of with a direction to the second respondent to consider the representation dated 23.02.2026 submitted by the petitioner on its own merits and pass appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.
