PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 4 to take appropriate action to remove the illegal encroachment made by the respondents 5 to 7 on the public pathway comprised in Survey No. 266/1C1, converted into T.S.No.109, Ward-E, Block-2, situated at East Street, Millgate, 27th Ward, Karuthapuliyanpatti, Melur Taluk, Madurai District. ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The prayer in this writ petition is to issue a Writ of Mandamus, directing the respondents 1 to 4 to take appropriate action to remove the illegal encroachment made by the respondents 5 to 7 on the public pathway comprised in Survey No.266/1C1, converted into T.S.No.109, Ward-E, Block-2, situated at East Street, Millgate, 27th Ward, Karuthapuliyanpatti, Melur Taluk, Madurai District.

2. Learned Government Advocate appearing for the respondents 1 to 4 would submit that a survey will be conducted by the authorities in the place in question and if there is any encroachment, the same will be removed within a time frame.

3. Recording the above submission, the authorities are directed to conduct a survey in the place in question and during survey, if any encroachment is found, the same shall be removed by due process of law after affording sufficient opportunity to the private respondents and others concerned. The said exercise shall be completed within a period of two months from the date of receipt of a copy of this order.
