5. Thangamani : Respondents Prayer: Petition is filed under Section 482 of the Criminal Procedure Code to direct the third respondent not to harrasing the petitioner under the guise of an enquiry pertaining to civil dispute.

This petition has been filed seeking a direction to the third respondent Police not to harass the petitioner. 2.According to the petitioner, based on a complaint given by the fourth respondent, despite a civil dispute, the second and third respondents are harrassing the petitioner. Hence, the present complaint has been given.
3.Today, when the matter was taken up for hearing, the learned Government Advocate (Criminal side) appearing for the respondents 1 to 3, on instructions, submitted that the fourth respondent has given a criminal complaint against the petitioner before the second respondent Police alleging that the property belongs to the petitioner's father had executed a settelement deed in respect of the property belongs to the fourth respondent, thereafter, the petitioner mortgaged the said property in the Bank. second respondent has conducted an enquiry and the complaint has been now transferred to the third respondent. Now the third respondent only asked the petitioner to appear for enquiry. But, the petitioner without appearing for enquiry, has filed the present petition.
4.Considering the fact that only the enquiry is pending on the complaint given by the fourth respondent, the petitioner is directed to appear before the third respondent for enquiry and cooperate with the enquiry. The third respondent is directed not to harass the petitioner during the enquiry.
5.With the above direction, the Criminal Original Petition stands disposed of.
