For Respondent : Mr.T.Senthilkumar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police, for the offence punishable under Sections 498A and 494 of IPC and Section 4 of Dowry Prohibition Act, in Crime No.not known of 2021, on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner, who is already a married man, married the defacto complainant on 11.11.2018, suppressing the earlier marriage.
3. The learned counsel for the petitioner submits that the defacto complainant is two years elder to the petitioner, out of which, there was a misunderstanding between them. CRL OP(MD). No.13857 of 2021 prayed for grant of anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent Police opposed for grant of anticipatory bail and submits that the defacto complainant is not willing to live with the petitioner. He further submits that the petitioner already married a woman and suppressing the same, he married the defacto complainant and now, he is also intending to marry another woman.
5. Considering the conduct of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
