Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 1st respondent to consider the petitioner representation dated 31.08.2016.

Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents 1 to 3. 2.Since no adverse order is passed against the 4th respondent and his interest is also protected in this order, notice to 4th respondent is dispensed with.

3. By consent, the Writ Petition itself is taken up for final disposal.

4. The present Writ Petition has been filed by the

petitioner seeking a direction to the 1st respondent to consider his representation dated 31.08.2016.

4.According to the petitioner, his brother/4th respondent had executed a settlement deed on 04.02.2005 in favour of his wife as if an oral partition took place between the petitioner and 4th respondent and registered the same on the file of Sub-Registrar, Nilakottai. Hence the petitioner made a representation dated 31.08.2016 to the respondents 1 and 2 to cancel the settlement deed dated 04.02.2005. The above application is still pending with them. Hence, the petitioner has filed the present Writ Petition.

5. In the above circumstances, without going into the merits of the case, the second respondent is directed to consider the representation of the petitioner, dated 31.08.2016 and pass appropriate orders on the same, on merits and in accordance with law, after issuing notice to 4th respondent and all the parties concerned and after giving sufficient opportunity to them, within a period of twelve weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. No Costs.
