ORDER
Heard the learned counsel on either side.
2.The petitioner is a defacto complainant. He wants the final report to be filed at the earliest.
3.When the matter was taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent submitted that final report in this case has already been filed and it was closed as Mistake of Fact.
4.The respondent is directed to serve a fresh RCS notice on the petitioner. The jurisdictional Court shall serve notice on the petitioner. The petitioner will have the right to file a protest petition. If the same is filed, the jurisdictional Court shall dispose of the same on merits and in accordance with law within a period of four weeks thereafter. All the contentions of the petitioner are left open.
