Respondents PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 3 to take appropriate action to halt all unauthorized residential constructions executed by Respondents No.6 and 7, on the lands reserved for the School and Commercial Complex in Survey Nos.43/1 (Part) and 45/1 (Part) at Padikasu Vaithanpatti Village, Srivilliputhur, consequent there on to direct the 5th respondent herein to cancel all fraudulent registrations, sale deeds, and gift deeds executed over the public utility lands through the Srivilliputhur SubRegistrar office. (Order of the Court was made by N.SATHISH KUMAR, J.) The prayer in this writ petition is to issue a Writ of Mandamus, directing the respondents 1 to 3 to take appropriate action to halt all unauthorized 2/5

residential constructions executed by the respondents 6 and 7, on the lands reserved for the School and Commercial Complex in Survey Nos.43/1 (Part) and 45/1 (Part) at Padikasu Vaithanpatti Village, Srivilliputhur and consequently to direct the 5th respondent herein to cancel all fraudulent registrations, sale deeds, and gift deeds executed over the public utility lands through the Srivilliputhur Sub-Registrar office.

It is the contention of the petitioner that the lands in the abovesaid survey numbers were originally acquired by the Tamil Nadu Housing Board and the said lands were earmarked for school and commercial complex, whereas, the allottees namely, respondents 6 and 7 violated layout rules by converting the public utility area into private residential plots and several houses have been constructed therein.

3. We are of the view that if there is any violation of layout condition by the private respondents, it is for the aggrieved party which is the Tamil Nadu Housing Board, to question the same. A blanket Mandamus at the instance of the petitioner for cancellation of sale deeds, cannot be granted. It is for the petitioner to work out his remedy in the manner known to law for violation of the layout conditions.

4. Hence, this Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
