2. The writ petitioner is a resident of Krishnapuram, Rajapalayam Taluk. He alleges that the 7th respondent herein had been illegally mining gravel in Ayan Kollan Kondan Village. He wants action to be taken against him.
3. When the matter was taken up for hearing, the learned Additional Government Pleader submitted that permission was granted in favour of the 7th respondent on 26.04.2017. The petitioner's counsel states that if the quantity of gravel permitted to be quarried by the 7th respondent is compared with his stock, discrepancy would be obvious and that itself would be a proof that there was illicit minding.
4. We do not want to brush aside this allegation. The report of the Tahsildar, Rajapalaym appears to confirm the allegation made by the writ petitioner. We therefore direct the Revenue Divisional Officer / R2 to look into the writ petitioner's complaint and take appropriate action under the relevant provisions of the Tamil Nadu Minor Mineral Concession Rules, 1959 against the 7th respondent. We make it clear that we have not gone into the merits of the matter. This exercise shall be completed by the second respondent within a period of 12 weeks from the date of receipt of a copy of this order. 3/6
