For Respondent : Mr.R.Meenakshi Sundaram, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.239 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25 of NDPS Act, 25(1)(a) of Arms Act and 4(1) (a) of Tamil Nadu Prohibition Act, in Crime No.239 of 2021, seeks anticipatory bail.

2.Reading of the FIR shows that while the respondent police party was on patrol duty on 08.05.2021, they went to the place of occurrence and found that this petitioner was there with a travel bag and flew away from the spot on seeing the police party. On search, they found 1 1⁄2 kgs of Ganja along with three knives and 45 liquor bottles. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent and not committed any offence as alleged by the prosecution. He would further submit that this is the second https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.19070 of 2021 bail petition and earlier petition in Crl.OP(MD)No.6951 of 2021 was dismissed on 19.05.2021.

4.The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner is having one previous case at his credit.

5.Even though, this is the second bail petition, on considering the bad antecedents of the petitioner, except that it is a false case, no other ground is explained by the learned counsel for the petitioner, to show his bonafide. Hence, there is no change in circumstances mentioned in the petition, this Court is not inclined to enlarge the petitioner on bail.
