ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(A) of the TamilNadu Prohibition (Amendment) Act, 2024 and Section 4(1)(aaa), 4(1)(i), 14A of TamilNdu Prohibition Act in Crime No.344 of 2025 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that on 14.06.2025 at about 10.15p.m, a team of police officials were engaged in regular patrol duty, at that time, they found that the petitioner along with one Mukesh were illegally sold the liquor bottles to general public in that locality. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is a innocent person and he has not committed any offences as alleged by the prosecution. The petitioner is ready and willing to abide any conditions which may be imposed by this Hon'ble Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that this petitioner and other accused were illegally transported 1320 liquor bottles and illegally sold it to others. The properties are worth about Rs.2,80,000/-. In this case, first accused was arrested and he is still in judicial custody. The quantity of property 2/4

involved in this case is huge one. This petitioner is having three previous cases. In this case, investigation is in preliminary stage. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

Considering the nature and gravity of the offence and considering the fact that huge quantity of property was involved in this case, this petitioner is having three previous cases, the co-accused is still in judicial custody, in this case, investigation is in preliminary stage, at this stage, this Court is not inclined to grant anticipatory bail to the petitioner.
