PRAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 3 to 5 herein to deposit the award amount of Rs.3,90,438/- with 12% interest in the proceedings in WC.No.33 of 2009 on the file of the Deputy Commissioner of Labour, Tirunelveli and failing which to direct the District Collector, Tuticorin to initiate Revenue Recovery proceedings against the respondents 3 to 5 herein as per law. O R D E R
This Writ Petition has been filed seeking Writ of Mandamus directing the respondents 3 to 5 herein to deposit the award amount of Rs.3,90,438/- with 12% interest in the proceedings in WC.No.33 of 2009 on the file of the Deputy Commissioner of Labour, Tirunelveli and failing which to direct the District Collector, Tuticorin to initiate Revenue Recovery proceedings against the respondents 3 to 5 herein as per law.
2. When the matter earlier came up for consideration on 19.03.2025, this Court directed the learned Special Government Pleader to ascertain why the respondent No.3 has not complied with the award passed by the respondent No.
1. In response to the same, Mr.F.Deepak, learned Special Government Pleader, on instructions, submitted that the entire amount due under the award passed in W.C.No.33 of 2009 has already been deposited by the respondent No.3 to respondent No.1 and the said amount was also disbursed in favour of the petitioner on 20.03.2020.
3. In the light of the above, the relief sought in the Writ Petition has become infructuous and accordingly, this writ petition is dismissed having become infructuous. There shall be no order as to costs. 25.03.2025 Index :
