ORDER

The petitioner herein seeks a direction to the 3rd respondent to dispose of his appeal dated 08.05.2025.

2. Heard the learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents.

3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself.

4. According to the petitioner, the subject property in S.No.39/17 at Idayanvayal Village at Thirumayam Taluk, Pudukkottai District originally belonged to the petitioner's husband's grandfather namely Karuppan. After the death of the said Karuppan, his sons Avudai and Sambaan got the 2/6

property. The above said Avudai had three sons (including the petitioner's husband) and three daughters. The said Sambaan had three sons and four daughters. There was an oral partition between Avudai and Sambaan and the subject property was equally divided between the brothers and each brothers were allotted with 1.04 ares. After the death of the petitioner's husband, the petitioner's husband's paternal uncle namely Sambaan got UDR in his name by concealing the existence of other sharers. Therefore, the petitioner submitted a representation on 29.04.2025 before the 3rd respondent seeking rectification of UDR entries by including the petitioner's name. The same has not been considered. Hence the petitioner has come before this Court.

5. The learned Additional Government Pleader, who takes notice for the respondents would submit that the correction in UDR can done only by the 2nd respondent and hence, the representation submitted by the petitioner before the 3rd respondent cannot be considered by him. 3/6

In view of the said submission made by the learned Additional Government Pleader appearing for the respondents, the 3rd respondent is directed to forward the representation of the petitioner dated 29.04.2025 to the file of the 2nd respondent within a period of two (2) weeks from the date of receipt of a copy of this order. The 2nd respondent shall consider the representation of the petitioner dated 29.04.2025 and pass final orders on its own merits and in accordance with law within a period of twelve

(12) weeks from the date of receipt of representation from the 3rd respondent, after issuing notice to the petitioner and other interested parties.

7. The writ petition is disposed of with the above observations. No costs.
