ORDER

The petitioner has approached this Court with a grievance that the respondent Police is harassing him under the guise of enquiry. 2.The learned Government Advocate(Crl.side) appearing for the respondents submits that the petitioner is selling lotteries as against the prohibition order. Further, he submits that the petitioner is having 13 previous cases, in which, 8 cases were registered under the provision of Lotteries Act and therefore, in order to ascertain as to whether the petitioner is still involving in selling of lotteries, the respondent Police has visited the petitioner's house and they are not harassing him. 3.The learned counsel appearing for the petitioner submits that the petitioner has changed his attitude and now, he is working in a welding shop. Further, he submits that the petitioner has also prepared to given an undertaking that he will not indulge in any lottery business hereafter. 4.Considering the submission made on either side, this Court directs the petitioner to appear before the second respondent Police and 2/4

shall give an undertaking affidavit that he will not indulge in lottery business and also undertake about his avocation. The respondent Police shall not harass the petitioner hereafter. Accordingly, this criminal original petition is closed.
