ORDER
The petitioner has approached this Court for a Writ of Mandamus to direct the first respondent to reissue/renew the passport bearing No.M9657601 to the petitioner by processing his application in File No.MD1075017696625 based on the explanation/representation dated 04.06.2025.
2. There appears to be a domestic dispute between the petitioner's brother and his wife, where the petitioner has also been proceeded under the provisions of IPC and Section 4 of TNPHW Act. The petitioner is an accused in an FIR in Crime No.173 of 2022 and an FIR in Crime No.12/2021, which have now been taken on file in S.C.No.638 of 2023 before the Mahila Court, Madurai and C.C.No.62 of 2022 before the Additional Mahila Court, Sivagangai respectively.
3. It is noticed that the petitioner was a holder of a passport issued on 03.06.2015, which was valid upto 02.06.2025. Therefore, there cannot be any objection for re-issuance of the passport. However, considering the fact that two
cases are pending in two different Courts, one in Madurai and another in Sivagangai, there shall be a direction to the first respondent to process the application of the petitioner and issue the same in the name of the petitioner. However, the same shall be deposited before the Mahila Court, Madurai, where S.C.No.638 of 2023 is pending. It is for the petitioner to move suitable application for release of the passport after obtaining necessary orders from both the Courts.
4. Accordingly, the Writ Petition stands disposed of. There shall be no order as to costs.
