ORDER

This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner, learned Central Government Standing Counsel for the first respondent and learned Government Advocate (Crl.Side) for the second respondent.

2. The petitioner/Managing Director of the T.P.Textiles (P) Ltd., Virudhunagar, was involved in an accident. Therefore, an FIR came to be lodged against the petitioner before the second respondent in Crime No. 168/2016, for the offences under Sections 304(A) and 279 of IPC r/w 181(3) of the Motor Vehicle Act, 1988.

3. By the impugned order, dated 17.04.2024, the petitioner's passport has been impounded after the petitioner has been issued with Show Cause Notice dated 03.04.2023.

4. It is noticed that the impugned order states that although the Show Cause Notice issued to the petitioner on 27.03.2024, there is no response from the petitioner and therefore, impugned order has been passed.

5. However, it is noticed that the impugned order records as if the petitioner has not replied, although the petitioner had indeed replied on 29.04.2023.

6. Under these circumstances, the impugned order is set aside and the matter is remitted back to the first respondent to pass fresh orders, considering the petitioner's reply, dated 29.04.2023.

7. The first respondent shall pass final order on merits within a period of 15 days from the date of receipt of a copy of this order. 3/5

8. It is made clear that before passing the final order, the petitioner shall be heard.
