Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents 2 to 4 to cancel the electricity connection No. 343-022-1876 of the sixth respondent and to grant electricity connection to the name of petitioner in respect of the land in S.No. 79/2B6, Thiruvarangam Group, Mudhukulathur Taluk, Ramanathapuram District, by considering the petitioner's representation dated 05.11.2024.

ORDER
This writ petition has been filed seeking direction to the respondents 2 to 4 to cancel the electricity connection No. 343-022-1876 of the sixth respondent and to grant electricity connection to the name of the petitioner in respect of the land in S.No. 79/2B6, Thiruvarangam Group, Mudhukulathur Taluk, Ramanathapuram District, by considering the petitioner's representation dated 05.11.2024.
2.This Writ Petition is disposed of at the time of admission, 2/7
after hearing the learned counsel for the petitioner, learned Government Advocate for the respondents 1 and 5, learned Standing counsel for the respondents 2 to 4 and after dispensing with the notice on behalf of the sixth respondent, who is none other than the petitioner's estranged husband.
3.It is a specific case of the petitioner that the petitioner is the owner of the land in S.No.79/2B6, measuring an extent of 0.37.0 hectares and the petitioner's husband namely, the sixth respondent is the owner of the land in S.No.79/2C1 measuring an extent of 59.50 ares, adjacent to the petitioner's land. It is further case of the petitioner that there is a bore-well in the petitioner's land, which was sunk by the petitioner after obtaining necessary incentives from the fifth respondent. It is submitted that there is no bore-well in the sixth respondent's land. However, the petitioner's estranged husband namely, the sixth respondent has obtained electricity connection by showing bore-well in the petitioner's land. When the petitioner approached the respondent Nos.2 to 4 seeking for electricity connection to her bore-well, she was informed that already there was a connection for her bore-well in the name of the petitioner's estranged husband namely the sixth respondent. Hence, this petition. 3/7
4.Although the petitioner and the respondent are not divorced, they are having the status of husband and wife. 5.Considering the fact that they are estranged and that the land in the name of the petitioner and the petitioner's husband are in different survey numbers, there shall be a direction to the fourth respondent to consider the petitioner's representation dated 05.11.2024 and dispose of the same on merits and in accordance with law, after giving due notice to the sixth respondent. In case, the connection has been wrongly given to the sixth respondent, the same shall be cancelled and fresh connection shall be handed over to the petitioner. The said exercise shall be completed by the fourth respondent within a period of six weeks from the date of receipt of a copy of this order.
6. This writ petition stands disposed of with the above direction. There shall be no order as to costs.
